Introduction
Welcome to ArthurTully! This Terms of Use agreement (the “Agreement”) governs the use of our website and services. By accessing or using our website and services, you agree to be bound by this Agreement.
Intellectual Property
You retain ownership of all intellectual property rights in and to the work product and materials created by you, including, but not limited to, videos, stream overlays, and any other content created for you.
Service Terms
Our services include audio and microphone setup, OBS/Streamlabs stream setup, stream overlay design, and video editing. We will provide these services in a professional and timely manner.
Payment Terms
One-time Consultation: Payment is due upfront before the consultation.
Monthly Subscription: Payment is due on the same date each month as the first payment. Failure to make timely payment may result in cancellation of service.
Hourly Services: Payment is due weekly or monthly, as agreed upon. Failure to make timely payment may result in cancellation of service.
Cancellation Policy
If a client cancels twice, we reserve the right to refuse further service to that client. In the event of a cancellation, we will provide proof of work and issue a partial refund for any service not rendered. If a client requests a refund after the service has been fully completed, we will not offer a refund.
Refund Policy
If you are not satisfied with the work, you have 2 revisions within 14 days. If you are still not satisfied, a partial refund may be issued at the discretion of the Freelancer.
Confidentiality
We will not disclose any confidential or proprietary information provided by you, including but not limited to your usernames, email or logo, without your prior written consent.
Governing Law
This Agreement will be governed by and construed in accordance with the laws of Serbia. Any disputes arising out of or related to this Agreement will be resolved through arbitration.
Indemnification
You agree to indemnify and hold harmless the Freelancer against any claims, damages, or expenses arising from your use of the services, including but not limited to claims for intellectual property infringement or misrepresentation.
Data Protection
The Freelancer shall maintain the confidentiality and security of all client data and shall not disclose such to any third party without the prior written consent of the Client.
Termination
The agreement may be terminated by either party upon 14 days’ written notice to the other party. In the event of termination, the Freelancer shall return all client materials and intellectual property to the Client.
Assignment
You may not assign or transfer this agreement without the prior written consent of the Freelancer.
Severability
If any provision of this agreement is found to be invalid or unenforceable, the invalid or unenforceable provision shall be severed, and the remaining provisions shall remain in full force and effect.
By using our website and services, you acknowledge that you have read, understand, and agree to be bound by these Terms of Use.
